Is it permissible to pray with the intention of Asr with those who Pray Dhuhr late?

Answer:

The lajnah stated:

ولا يضره اختلاف نيته عن نية الإمام على الصحيح من قولي العلماء ، ما لم يخل ذلك بنظمها كمن يصلي المغرب خلف من يصلي العشاء وقد فاتته ركعة .

And it does not hurt if the Imaam’s intention is different (from the one praying behind) according to the correct saying of the scholars. It does not matter, like one who prays Maghrib different from praying Ishaa (which the rest of the people are doing) while there is a shortage of one rakah (in Maghrib as opposed to ishaa).

Shaykh Bin Baz was asked the following question:

دخلت المسجد وصلاة العشاء قائمة، وقبل الدخول في الصلاة تذكرت أنني لم أصل المغرب، فهل أصلي المغرب ثم أدرك ما أدرك من العشاء مع الجماعة، أم أصلي مع الجماعة ثم أصلي المغرب بعد ذلك؟

I entered the masjid while Salaatul Ishaa had (started being) established. And before I entered into the Salaah, I remembered that I did not pray Maghrib. So do I pray maghrib then catch what I need to catch from Ishaa with the congregation or do I pray with the congregation then pray maghrib after that?

He replied by saying:

إذا دخلت المسجد وصلاة العشاء مقامة، ثم تذكرت أنك لم تصل المغرب، فادخل مع الجماعة بنية صلاة المغرب، وإذا قام الإمام إلى الركعة الرابعة فاجلس أنت في الثالثة واقرأ التشهد الأخير – أعني التحيات والصلاة على النبي صلى الله عليه وسلم – والدعاء بعدها وانتظر الإمام حتى يسلم ثم تسلم معه، ولا يضر اختلاف النية بين الإمام والمأموم على الصحيح من أقوال أهل العلم، وإن صليت المغرب وحدك ثم دخلت مع الجماعة فيما أدركت من صلاة العشاء فلا بأس.

When you enter the masjid and Salaatul Ishaaa is being established, then you remember that you did not pray maghrib, then enter with the congregation with the intention of Salaatul Maghrib. And when the Imaam stands for the fourth rak’ah (of Ishaa) then sit in the third (rak’ah) and read the last tashahhud. Namely (in other words) the tahhiyyaat, and the salaah upon the Prophet Salallaahu Alayhi Wa Sallam and the duaa after it and wait until the imaam does the tasleem then you do the tasleem with him. ***And there is no problem in the differing of the intention between the Imaam and the ones being led according to the correct saying of the people of knowledge. *** And if you pray Maghrib alone then you entered with the congregation in what you catch from Salaatul Ishaa, then no problem.
