Shaykh Abu Abdir Rahmaan Yahyaa Bin Alee Al-Hajooree was asked:
Question:
“Some businessmen bring dates in Ramadan for those who are fasting. The month of Ramadan ends while some dates remain. Is it allowed for the one who is not fasting to eat from it or to give it to the students of knowledge, knowing that if it remains it will spoil?”
Answer:
“
The Prophet (ﷺ) said:
لا يحل مال امرئ مسلم إلا بطيبة من نفسه
‘The wealth of a Muslim is not permissible except with his good will’
[Reported by Ibn Hibban (no. 5978) and Ahmad (5/425) on the authority of Abu Humaid. It has also come from Abu Murrah ar-Raqaashi]
These people gave the dates from their good will. So as long as they gave it from their good will, it is the same whether it is for those who are fasting or those who are not fasting. Is it stipulated upon them that they break their fast with it while they are fasting and not to eat it when they are not fasting? If this restriction was made, then it is a must to restrict it. If this restriction did not come, then they can eat it in Ramadan and they can eat what remains in other than Ramadan, for those who are fasting or those who are not fast due to the aforementioned Hadith”.
