Shaykh Muqbil bin Hadi al-Wadi’i was asked:
Question:
A person entered into an animal, what ruling should be applied to him?
Answer:
He is to be punished. As for the animal, we went under the opinion that it should be put to death until a man asked me for a verdict when I used to reside in Medinah. He used to have a sheep or a large goat and he found a boy entering into it. He sought council with me on his coarse of action, I said it must be put it death. The man killed the animal and was very saddened having done so because Mashaa’Allah, it used to provide them with a lot of milk. Now it has become clear to us that the Hadith [regarding that] is weak. The hadeeth of Ibn ‘Abbaas (may Allah be pleased with him):
The Messenger of Allah (blessings and peace of Allah be upon him) said: “If you find that someone has had intercourse with an animal, kill him and kill the animal too.”
[Narrated by Abu Dawood (4464) and at-Tirmidhi]
Therefore, he is to be punished and nothing is to be done to the animal because it has not been ordered to follow the legislation.”
