Question:
What is the ruling on swearing by saying “by the Right of the Quran” and “by the Right of the Womb (ie. Kinship)”?
Answer:
If the intent is by the revealed Quranic verses, then this is an attribute from the attributes of Allah and it is permissible to swear by this. And if the intent is by the paper, and the ink, and the book covers, then this is considered swearing by other than Allah, and it is not permissible. And also like that [swearing by the Right of the Qur’an] is swearing by the Right of the Womb. The Messenger, may Allah send blessings and peace upon him and his family, said: “Whomsoever must swear, then swear by Allah or remain silent”
