Some Observations And Critical Points Which Were Observed Against Dr Falaah Isma’eel, May Allaah Grant Him Success:

1. Dr Falaah’s Verdict In Aqeedah

Dr Falaah Isma’eel, may Allah grant him success, was asked the following question:

السؤال: ما حكم الحلف بحق الله؟

Question:

“What is the ruling on taking an oath by saying, “By the Right of Allah”? ”

الجواب: لا مانع من ذلك ، فحق الله هو توحيده سبحانه وتعالى ، وهو إفراده بالألوهية والعبادة وربوبيته سبحانه وأسمائه وصفاته ، والله أعلم .

Answer:

“There is nothing preventing that, the right of Allah is his Tawheed (singling Him out in worship) Subhaanahu wa Taala, and it is to single him out in His worship, His Lordship Subhaanahu, and in His Names and Attributes and Allah knows best.”. End translation. [Reference]

The Lajnah ad-Daa’imah was asked the following question:

س : ما حكم من حلف بلفظ : وحق الله؟

Question:

“What is the ruling on taking an oath by saying “By the Right of Allah?” ”

ج : لا يجوز الحلف إلا بالله أو صفة من صفاته، وحق الله هو عبادته وحده لا شريك له، وذلك من أفعال العباد، فلا يجوز الحلف به

Answer:

“It is not permissible to take an oath by anything except Allah or one of His attributes. The right of Allah is to worship him alone with no partners, which is an act done by the people, so it is impermissible to take an oath by.

May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.

Also Ash-Shaykh Abdul-Muhsin al-Abaad, may Allah preserve him, was asked the following question:

سائل : هل يصح الحلف بــ **وحق الله**

Question:

“Is it valid to make an oath by the right of Allah?”

الشيخ: لا,لأن حق الله العبادة, حق الله على العباد أن يعبدوه فلا يحلف بالعبادة, بعبادة الله.

Answer:

“No, since the right of Allah is the ‘Ibadah, the right of Allah upon his servants is for them to worship him. Therefore one should not swear by the ‘Ibadah, the worship of Allah.” End translation. [Sharh Sunan Ibn Maajah #69 (01:08:18)]

Likewise Ash-Shaykh Bin Baaz, rahimahullah, was asked the following question:

السؤال :ما حكم الحلف بهذا اللفظ ‘بحق الله’ هل يعتبر شركا ولو لم يقصده ؟

Question:

“What is the ruling on taking an oath by saying “By the Right of Allah”? Is that considered to be a form of shirk even if he didn’t intend it?”

الجواب:

لا يحلف بحق الله ,يحلف بالله والله بعزة الله والرحمن الرحيم وخالق كل شيئ ورب العالمين والذي نفسي بيده ولا يحلف بحق الله لأن حق الله علينا تعظيمه وطاعته وتعظيمه وطاعته من أفعالنا, من أفعال المخلوقين حق الله علينا توحيده وطاعته وتعظيمه وتوحيدنا له وتعظيمنا له وطاعتنا له من أفعالنا وهي مخلوقة فمعناه الحلف بالمخلوقات فلا يصح. الحلف لايكون إلا بالله وحده أو بأسمائه وصفاته.

Answer:

“One should not make an oath by the right of Allah. He should make an oath with Allah, By Allah, By His Might and His Name ar-Rahman ar-Raheem, The Creator of everything and By the One who my soul is in His Hand. One should not take an oath by saying “By the right of Allah” because the right of Allah over us is to glorify Him and it is His obedience; while the act of obedience is from our actions, from the actions of the creation. The right of Allah upon us is to single him out and to obey Him. And our act of singling Him out and glorifying and obeying Him are from our actions while they are created, which means it is making an oath by the creation, which isn’t valid. The oath can only be by Allah Alone, or By His Names and Attributes.” End translation. [From the lesson, “The acts which taint the Aqeedah” by Bin Baaz, rahimahullah”.

Also on the audio above, Ash-Shaykh Abdur-Razaaq Badr clarifies that swearing by the Right of Allah is actually swearing by the actions of the creations which is not permissible:

2. Dr Falaah’s Restricted Concept On Testing The People

Dr Falaah, may Allah grant him success, said in the above audio,

“…It [i.e. testing the people] is not permissible oh slave of Allah. The people should not be tested except pertaining to three matters. They are tested in regards to the Quran, in regards to your stance concerning the Quran and your stance concerning the Sunnah of the Prophet Sallalahu Alaihi Wassallam and your stance towards the Honorable Sahabaas radiallahu ta’ala anhum. This is the basis for testing the people pertaining to the religion; This is the basis of al-Walaa and al-Baraa in the religion. Yes, whosoever’s mistake becomes apparent, we should keep far [from him] and we should not follow him upon his mistake. Whosoever’s innovation becomes more apparent, then we should keep far from him even more. Whosoever’s disbelief becomes apparent, we should separate from him. Yes, but as for us searching for it, no oh slave of Allah. We should not search for it nor follow it up nor spy for it nor should we read these issues between the aqraan (i.e. the peers), never, naam”. End translation.

Ash-Shaykh Zayd al-Madkhalee, rahimahullah, said,

يُمتحنُ النَّاسُ في كلِّ زمان ومكان بأهلِ السُنَّة عقيدةً وشريعةً, أي الذين نذروا أنفسهم لحفظِ السُنَّة, وفهمِ معاني نصوصها, والعملِ بها والذبِّ عنها. وليس امتحانُ النَّاسِ بأهلِ السُنَّةِ مقصوراً على شخص معيّن أو أشخاص, بل يُمتحنُ النَّاسُ بكلِّ صاحبِ سُنَّة في كلِّ زمان ومكان على الوصفِ الذي ذكرتُم, وكذلك يُمتحنُ النَّاسُ بأهلِ البدعِ الداعين إليها؛ فعن عُقبةَ بنِ علقمة قال: كنتُ عند أرطأةَ بنِ المنذرِ فقالَ بعضُ أهلِ المجلسِ: ما تقولونَ في الرّجلِ يجالِسُ أهلَ السّنّةِ ويخالِطُهم ، فإذا ذُكِرَ أهلُ البدعِ قالَ: دعونَا مِن ذكرِهم ، لا تذكروهُم! قالَ أرطأةُ : هوَ مِنهم ، لا يلَبِّس علَيكم أمرَه ، قالَ فأنكرتُ ذلكَ مِن قولِ أرطأةَ ، قالَ: فقدِمتُ علَى الأوزاعِيّ وكانَ كَشّافاً لهذهِ الأشياءِ إذا بلَغَته ، فقالَ «صدقَ أرطأةُ ، والقولُ ما قالَ ، هذا يَنهىَ عن ذكرِهم ، ومتَى يُحذَرُوا إذا لم يُشاد بذكرِهم؟!» (تاريخ دمشق 8/15)

وقال الأوزاعي رحمه الله: «مَنْ سَتَرَ عَلَيْنَا بِدْعَتَهُ, لَمْ تَخْفَ عَلَيْنَا أُلْفَتَهُ» (الإبانة لابن بطة: 2/479)

«الأجوبة الأثرية عن المسائل المنهجية ص27-29»

“…The people are to be tested in every time and place with Ahlus Sunnah of Aqeedah and Sharee’ah, meaning those who have dedicated themselves in preserving the Sunnah, in understanding the meaning of its texts, and acting upon it and defending it. Testing the people with Ahlus Sunnah is not restricted to a specific individual or to certain individuals. Rather, the people may be tested with every person of Sunnah in all places and at all times in the manner that I have mentioned. Likewise, the people are tested with the people of innovations, those who are callers to it.

‘On the authority of Uqbah bin Alqamah who said, “I was with Arta‘ah Ibn Mundhir. So some of the people in the gathering said, ‘What do you say about the man who sits with Ahlus Sunnah and mixes with them, but when the people of innovation are mentioned, he replies, “Leave us from mentioning, do not mention them.”‘ Arta‘ah replied, ‘He is with them, do not be deceived by his affair.’ He said, “So I objected to the statement of Arta‘ah”. He said, “So I went to al-Awzaa’ee, since he was strong in discovering these issues when I would convey it to him, so he said, ‘Arta‘ah has spoken the truth. And the correct statement is what he said. This individual prohibits their mention, so when will they be warned against if they aren’t encouragingly mentioned?!'”‘ End quote. [Tareekh Damashiq (8/15)]..”. End translation.

Likewise al-Awzaa’ee rahimahullaah, said, “Whosoever hides his innovation from us, his friends won’t be hidden from us.”. End translation. [al-Ajwibah al-Athariyyah (27-29)]

3. Dr Falaah’s Statement That You Won’t Find An Innovator In The Dunya Who Is Pleased To Read Al-Usuul As-Sittah

Dr Falaah Isma’eel, may Allah grant him success, said in the above audio,

“…The likes of this book [i.e. the book ‘Six Principles’], is this book read among the people of innovation? Is there an innovator in this world that reads this book?! Or is pleased with the likes of al-Usuul as-Sittah?! [It is that] which tears away the roots of innovation from its foundation Oh slave of Allaah. It does not leave a root from the roots of innovation except that it removes it. All of Usuul of Sittah bangs on the heads of the people of innovation, day and night. I do not think that they will be pleased with this book. The first thing they asked me is, ‘what book are you going to give an explanation for?’ I replied, ‘I would like to give an explanation to the book al-Usuul as-Sittah’ And they became joyful and they never said, ‘No, No we don’t want (this).’ By Allaah, we didn’t hear them say this…”. End translation.

A Comment: This statement is erroneous since we cannot reject the detailed criticism which was brought forward against individuals who Dr Falaah Isma’eel may visit merely due to the reason they are okay with reading the book Usuul as-Sittah.

4. Dr Falaah’s Statement That We Shouldn’t Waste Our Time In Reading Refutations And He Makes An Example For This The Refutations On Ali Halabi

Dr Falaah Isma’eel, may Allah grant him success, said in the above audio,

“…By Allah, we don’t have time to read refutations, nor do we waste our time in refutations. We weren’t created for this oh Slave of Allah…”. End translation.

Ash-Shaykh Zayd al-Madkhalee, rahimahullah, once said pertaining to the likes of this statement,

“This is from the doubts of [the people] of falsehood. I doubt that the likes of this statement would be spread by one who has a small amount of knowledge because the books of refutations are available and distributed, published and are being read [by the people] from the early eras to this era. So the books of refutations are [considered] Jihaad in the path of Allah. Rather, Ibn al-Qayyim, may Allah have mercy upon him, considered refutations upon the people of innovations and the people of desires to be greater than Jihaad of the battlefield. So if this statement comes from one who is ignorant, then it is a must that he be taught. And if it comes from an individual that claims knowledge, then he is either an ignoramus that thinks he knows or a person of deception who [the people] must be aware of and should be warned from”. 5. Dr Falaah’s Statement That A Person Is Not Responsible To Know The Conditions Of Those Who Were Declared To Be Innovators By The Scholars

Dr Falaah Isma’eel, may Allah grant him success, said in the above audio,

“…We always say we don’t want it to become a habit for us to ask about the ruling on so-and-so. We just read regarding it just a short while ago on the question, ‘what is the ruling on so and so?’. Our Lord will not take you account for that nor are you responsible about this. You are responsible to seek your aqeedah. You are responsible to seek your prayer, your purification, your worship, your zakat, your hajj. Seek these beliefs, oh servant of Allah, and know the affairs which will benefit your religion and which lead to actions. As for so-and-so, then perhaps all of a sudden so-and-so was declared an innovator by the Ulemaa, then khalaas, [it is said] I am in need of the speech of the scholars. Also, it is not necessary likewise that I go and say so-and-so is an innovator…”. End translation.

Ash-Shaykh Yahya al-Hajooree, may Allah preserve him, was asked the following question:

Question:

“What do you say about the one who says that Allaah will not ask you why didn’t you declare so-and-so a Hizbee and why you didn’t make takfir on so-and-so?”

Answer:

“By Allaah he will ask me! He the Lord of the Worlds will ask me. Allaah Aza Wa Jal states,

إِنَّ الَّذِينَ يَكْتُمُونَ مَا أَنْزَلْنَا مِنَ الْبَيِّنَاتِ وَالْهُدَىٰ مِنْ بَعْدِ مَا بَيَّنَّاهُ لِلنَّاسِ فِي الْكِتَابِ أُولَٰئِكَ يَلْعَنُهُمُ اللَّهُ وَيَلْعَنُهُمُ اللَّاعِنُونَ

Verily, those who conceal the clear proofs, evidences and the guidance, which We have sent down, after We have made it clear for the people in the Book, they are the ones cursed by Allah and cursed by the cursers. [Surah Al-Baqarah Verse 159]

How can I not be afraid that Allaah will not ask me? Whoever of you sees an evil then let him stop [change] it with his hand. Is Bid’ah [innovation] from the evils or not? Its adherents spread it. Also it is necessary to be cautious and to warn from them, preventing [others] and keeping away from them.

Then if he cannot [i.e. stop the Munkar/evil], then with his tongue. If he cannot prevent it with his tongue, then with his heart and that is the weakest of Emaan. Amazing! What kind of a feeble precept is this? How will he not ask me? The proof is:

وَاسْأَلْهُمْ عَنِ الْقَرْيَةِ الَّتِي كَانَتْ حَاضِرَةَ الْبَحْرِ إِذْ يَعْدُونَ فِي السَّبْتِ

And ask them (O’ Muhammad) about the town that was by the sea, when they transgressed in the matter of the Sabbath (i.e. Saturday). [Surah Al-A`raf Verse 163]

Allaah transformed them into monkeys and pigs those who didn’t condemn but rather endorsed it. The proofs are many in regards to this subject [i.e. the subject of saying “Allaah will not ask you in regard to talking about so-and-so.”]

Condemning liars is from the greatest advice in the Deen. If Jahm Bin Safwaan was not condemned, then how would the creed of the Muslims have been? If Imam Ahmed had not undertaken what Allaah made incumbent on him in his Deen, if Abu Bakr As-Sideeq did not establish what Allaah made incumbent upon him in the affairs of Ridda [apostasy], then how would the conditions of the Muslims have been after the death of the Messenger of Allaah? This speech is feeble, oh brother! It is as if he has not even smelled the aroma of the Sunnah and `Ilm.” End translation. [Reference not available anymore].

6. Dr Falaah’s Verdict That Is Allowed To Trim The Beard For Work Purposes If The Person Is In Need Of A Job And Can’t Find Another Job Or For A Soldier Who Is Obliged To Trim His Beard By The Government And Can’t Find Another Job

7. Dr Falaah’s Harsh Accusation That The State Of Those Who Accept The Refutations On Saalim At-Taweel Is Similar To The State Of Those Who Will Follow The Dajjaal When He Comes To Them

Dr Falaah, may Allah grant him success, said in the above audio,

“…Those who believe in it (i.e. the refutations against Saalim Taweel), their state is similar to the state of those who will believe in the Dajaal…these people, if the Dajaal were to come to them, they would all follow him…” End translation.

8. Dr Falaah’s Statement About It Being Compulsory To Advise Him About His Mistake Prior To Clarifying It To The Public

Dr Falaah Isma’eel, may Allah grant him success, said in the above audio clip,

“…It is incumbent that you advise me prior to you broadcasting my mistake. If I have fallen into a mistake or it reaches you that I have fallen into a mistake, then it is waajib (compulsory) for you to advise me (concerning this mistake) prior to you broadcasting it, O slave of Allah!” End translation.

Comment: This statement requires further restrictions since there are some mistakes which may require a public clarification and likewise there are certain instances wherein it is encouraged to be addressed in public prior to addressing it in private.

Ash-Shaykh Zayd al-Madkhalee, rahimahullah, was asked the following question:

هل يشترط النصيحة قبل التحذير؟

Question:

“Is it a condition to advise before warning?”

التحذير نصيحة ، التحذير من فعل الحرام من فعل البدع على اختلاف أنواعها من المخالفات هو نصيحة للناس فلا فرق بين التحذير من الحرام باختلاف أنواعه وبين النصيحة

Answer:

“Warning is advice, warning from carrying out Haraam and warning from carrying out Bidah (innovations) in all of its forms and from all that which opposes (the Sunnah) is advice to the people. So, there is no difference between warning from that which is Haraam and its different forms and between the act of advice.”

Also, Ash-Shaykh Saaleh al Fawzaan (hafidhahullaah) was asked in the above audio regarding the ruling of a student of knowledge who follows up the mistakes of some of the Du’at, then compiles it and distributes it in tape form, and if this is from the manhajus-salafi?

Answer:

“If the intention (of the person) is to clarify the truth and clarify the mistake, then this is good. This is from da’wah to Allaah that we clarify the mistakes so that the people do not fall into it. However, if the intention (of the person) is to please his own desires and to seek revenge against the person and to degrade the honor of the person, then this not permissible.” End translation.
