Shaykh Muqbil bin Hadi al-Wadi’i was asked:

▪السؤال:
رجل مات وعليه صوم رمضان لم يستطع أن يصوم منه يوماً واحداً بسبب المرض الذي أحل به ومات وعليه الشهر كاملا ، هل يجوز أن يصوم عنه أولاده الكبار بالتساوي كل واحد منهم عشرة أيام في وقتٍ واحد ، أم لا ، أفيدونا في هذا جزاكم الله خيراً ؟

Question:

A man passed away in the month of Ramadan. He was not able to fast any day due to his illness and the whole month [of Ramadan] was upon him. Is it permissible for each of his elder children to fast 10 days at one time on his behalf or not?

Benefit us in this. Jazakumullahu khairan.

▪ الإجابة:
يجوز ؛ لقول النبي – صلى الله عليه وعلى آله وسلم – : ” من مات وعليه صوم صام عنه وليه ” .

وأولاده يعتبرون من أولياءه .

Answer:

‘It is permissible. The Messenger of Allah (Sallallahu Alaihe Wasallam) said:

“Whoever dies and upon him was to fast, then his heir/inheritor can fast on his behalf”.

[Agreed upon]

And his children are considered from his inheritors/heirs.’
